Litigation Update: President Trump’s Anti-DEI Executive Orders and the Lawsuits Challenging Them

Immediately after taking office, President Trump issued Executive Orders that were intended to eliminate Diversity, Equity, and Inclusion (“DEI”) from government, education, and the private sector. But individual plaintiffs, advocacy groups, and some State Attorneys General initiated several lawsuits to block those Executive Orders and related agency actions, and courts have also already issued several rulings enjoining various aspects of President Trump’s policies.
In this litigation update, the panel will survey the complex DEI litigation landscape and address the various legal questions that have been raised, such as the scope of federal anti-discrimination law, the interplay between anti-discrimination laws and the First Amendment, the government’s ability to and procedure for withhold federal funding, and much more.
