New York Courts Announce Schedule for 2026 Primary Election Appeals

The New York State Court of Appeals and the four Appellate Division Departments have released their schedule for hearing appeals related to the June 23, 2026, primary election.

Under this schedule, the First Department will hear appeals on May 12 and, if necessary, May 13; the Second Department will hear appeals on May 13; the Third Department will hear appeals on May 12; and the Fourth Department will hear appeals on May 12. 

Additionally, the Court of Appeals will hear appeals and motions for leave to appeal related to the 2026 primary election on May 19, 2026.

Court proceedings commenced under Election Law Article 16 are required to take precedence over all other matters in New York State courts.  Candidates and campaigns anticipating litigation related to the 2026 primary election should feel free to contact one of our attorneys with experience in this area of law.
